The Cake Boutique LLC aims to produce products of the highest standard that delight you and enhance your special occasion. However, it is essential to remember that we are dealing with food art, and no two products are identical.

• Your cake is handmade and is, therefore, unique. We cannot guarantee to produce precisely the same design ordered from a picture or photo.
• The Cake Boutique reserves the right to exercise artistic license to guarantee a custom cake’s structural, visual, and creative integrity.
• We will do our best to match any requested color or pattern. However, remember that color can be subjective, and we must work within the boundaries of the color palette allowed by safe food ingredients.  The Cake Boutique LLC does not guarantee an exact match, nor do we offer discounts or refunds if the exact shade of a color is not achieved.
• We taste all our cakes to ensure the highest quality but remember that cake flavor and texture are subjective. The Cake Boutique LLC may consider a (partial) store credit if the product is brought back to us and the quality of the cake flavor or texture is determined not to meet our standards within 24 hours of you taking possession of the order.
• Variety in temperature and humidity may impact the cake’s flavor, overall design, or texture to some degree. Please understand that The Cake Boutique LLC is not responsible for changes in texture, color, or shape due to environmental conditions.
• Our cakes are baked from scratch with all-natural ingredients and must be kept at room temperature for at least an hour before serving.
• You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table and an optimal room temperature of 75 degrees Fahrenheit or below.

Deposits and payments

1. Your initial deposit of 50% of the total contract value reserves your event date and is non-refundable.
2. The Cake Boutique must receive your final payment by the due date and before taking possession of your order, or your contract is null and void; the deposit will not be refunded.
3. All our supported payment methods are listed on your invoice, which lists the total amount and payment due dates.

Liability

1. The Cake Boutique LLC is not responsible for bodily injury, property, or consequential damage which may result from our services.
2. The Cake Boutique LLC is not responsible for any damage to the cake after delivery, and the optional setup is complete.
3. The Cake Boutique is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond our control.
4. The Cake Boutique LLC is limited to the liability of the cost of your order.
5. You must inspect the cake upon delivery or pick-up to ensure the condition of the cake is satisfactory. Once you have accepted the cake, The Cake Boutique LLC is not responsible for the cake, including collapse, melting, pokes, etc.
6. You may pick up the cake, and when you do, you assume liability once it passes into your possession.

Postponement, changes, and cancellation

1. You must notify The Cake Boutique LLC if there is a change in the event date, location, or complete cancellation.
2. Any payments minus the nonrefundable deposit will be refunded if a cancellation occurs seven days or more before the event.
3. If a cancellation occurs within seven days of the event date, no refund will be given, and you must pay the final payment immediately.
4. Any changes must be submitted seven days in advance. Depending on the change, the total price of your order could change.
5. There will be no changes allowed from seven days before the event.

Serving amounts & sizes

1. The serving size is 1 inch wide x 2 inches long x 4 inches high for wedding cakes or 1.5 inches wide x 2 inches long x 4 inches high for party cakes.
2. Serving size estimations are not guaranteed to be exact.
3. The Cake Boutique LLC is not responsible for a shortage of cake if the pieces are cut too large.

Allergy & dietary warnings

1. The Cake Boutique LLC is a Texas Cottage Food Law business meaning all of our products are made in a home kitchen that is not inspected by the Department of Health Services or a local health department.
2. Please discuss any food intolerances or allergies before ordering our products. Although The Cake Boutique LLC makes every attempt to identify ingredients that may cause an allergic reaction for those with food allergies, we cannot 100% guarantee that common food allergens such as tree nuts, peanuts, eggs, soy, wheat, milk, fish, and crustacean shellfish will not end up in our products since these products are used in our kitchen.
3. You are responsible for pointing out potential allergy hazards to all your event guests.
4. The Cake Boutique LLC will not be liable for adverse reactions to food consumed or other items an individual may encounter while handling or consuming any of our products.

Ornaments & special equipment

1. A deposit is required for all rental equipment; your invoice will list the total required deposit.
2. The rental equipment must be returned within 48 hours of the event.
3. The returned rental equipment is evaluated, and a refund of the deposit is based on the condition of the items.
4. All personally supplied items must be submitted to The Cake Boutique LLC at least seven days before the event.

Photographs and marketing

1. We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission.
2. We reserve the right to photograph our baked goods and use those photos on our website, social media, or marketing materials without compensation.

Complaints

At The Cake Boutique LLC, we pride ourselves on our personal and professional service. We strive to make each order perfect. If, however, you have concerns about your order, please notify us immediately upon collection or delivery of the order so that we can rectify it in time for your event.

1. If you experience any problem with an order, complaints must be made within 24 hours of receipt of the cake, and the order may have to be returned to investigate the complaint.
2. Full refunds will never be given for any cake consumed, regardless of the dispute. Consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied.
3. Any total or partial refunds or store credits are at the sole discretion of The Cake Boutique LLC.
